Skramossa Animation Commission – Terms of Service

These Terms of Service (“Terms”) apply to all animation commissions (“Work”) created by Skramossa (“Artist,” “I,” “me”). By commissioning me, you (“Client”) agree to these Terms in full.
1. General
These Terms apply to every commission unless otherwise agreed in writing.
I reserve the right to decline any commission for any reason.
Commissions are limited, I don’t work on multiple big projects at once.
Communication will primarily occur via email or Discord depending on what is agreed upon hiring.
2. Scope of Work
I will create an animation based on the details the Client provides.
The Client must supply clear references, scripts, assets, or direction where necessary.
Creative interpretation is part of the process; I may adjust elements for clarity or quality.
Major changes requested after work has begun may incur additional fees.
3. Payment
All prices are provided upfront before the commission begins.
Payment is split into 50% upfront and 50% upon completion.
Payments are done through PayPal unless otherwise agreed in writing.
4. Revisions
Each commission includes 1 revision on each stage: storyboard, animatic, animation, and final edit.
Not all commissions will include every stage listed above.
Additional revisions or significant re-works may incur extra fees.
Revisions must be requested promptly after draft delivery.
5. Deadlines & Turnaround
Estimated completion time will be provided before payment.
Deadlines are flexible unless agreed upon as a hard deadline.
Rush orders may require an additional fee.
I will notify the Client of any delays as soon as possible.
6. Content Restrictions
I will not create animations involving:
Hate speech or extremist content
Explicit sexual content involving minors
Graphic violence or disturbing gore
Illegal activity
Anything I am personally uncomfortable with
I may decline or modify any commission that conflicts with these guidelines.
7. Copyright & Usage Rights
Artist Rights
I retain full copyright and ownership of all animations and assets created unless otherwise agreed in writing.
I may display the work publicly (including YouTube, social media, and promotional materials) unless the Client purchases exclusivity.
Client License (Limited Content Creator License)
Upon full payment, the Client is granted a non-exclusive license to:
Post and share the animation on social media platforms
Use the animation in livestreams and videos, including monetized content (excluding paid advertisements)
Display the animation publicly as part of their online content
This license does not transfer copyright.
Exclusivity
If the Client purchases exclusivity:
The Artist will not publicly post or redistribute the animation
The Artist may retain the work for private portfolio purposes only (e.g. linking to the Client’s published post)
Exclusivity fees are charged separately and are higher than standard commission rates due to lost promotional value
Timed exclusivity (e.g. delayed posting) may be negotiated separately.
Restricted Uses
The Client may not, without written permission:
Use the animation in paid advertisements or promotional campaigns
Use the animation for merchandise, branding, or resale
License or transfer the animation to third parties
Use the work to train or contribute to any AI or machine learning model
Use the work to create, mint, or sell NFTs or similar blockchain-based assets
8. Refunds & Cancellations
Payments are non-refundable once work has begun unless I cancel the commission.
If I cancel the commission, the Client will receive a full refund.
If the Client cancels after work has started, no refund is provided.
Chargebacks without communication result in permanent refusal of future commissions.
9. Delivery
Final animations will be delivered in MP4 format via Google Drive (or another agreed format/resolution).
The Client is responsible for downloading and backing up the files once delivered.
10. Client Conduct
The Client agrees to remain respectful and professional in communication.
Harassment or abusive behavior may result in cancellation without refund.
11. Acceptance
By commissioning an animation, the Client acknowledges they have read, understood, and agree to these Terms.
